Ban on eminent domain in South Dakota threatens to delay carbon-capture pipeline | OUT WEST ROUNDUP | News

Proposed Carbon Pipeline Delayed Due to South Dakota Law
The company Summit Carbon Solutions has announced its decision to indefinitely delay its $8.9 billion carbon-capture pipeline project following the passage of a law in South Dakota that limits the company’s ability to acquire land for the project. The 2,500-mile pipeline, which was set to carry carbon emissions from ethanol plants in five Midwestern states to be stored underground in North Dakota, had already received approvals in Iowa, Minnesota, and North Dakota. However, the new law in South Dakota bans the use of eminent domain specifically for carbon-capture projects, making it difficult for Summit to continue with the pipeline.

The delay in South Dakota has caused concern among ethanol producers in the state, who may now face a competitive disadvantage compared to out-of-state plants connected to the pipeline. Despite the setback, Summit Carbon Solutions has stated that all options are still on the table and remains committed to the project.
