In a controversial move, the new head of the nation’s Interior Department, Doug Burgum, has ordered a review of national monuments and mining protections issued under past presidential administrations. The order, issued late Monday, appears to target President Donald Trump’s previous review which resulted in the reduction of Bears Ears and Grand Staircase-Escalante in Utah. President Joe Biden later overturned these changes.

The order instructs assistant secretaries to review and potentially revise all withdrawn public lands, citing the law that allows presidents to designate national monuments and withdraw them from mineral development. Burgum, a former governor of North Dakota, stated that the goal is to unlock America’s energy potential while respecting tribal sovereignty and driving innovation in energy and environmental leadership.

The potential review could have significant impacts in Nevada, particularly on the Avi Kwa Ame national monument, which is sacred to Yuman-speaking Native American tribes. Republican Governor Joe Lombardo criticized the creation of the monument as a federal confiscation of land.

Conservation groups, such as the Center for Western Priorities, have criticized the decision, citing overwhelming support from Western voters for the preservation of national monuments. They fear that the new administration’s actions may lead to the opening of federal lands for mining and drilling.

It is unclear whether a sitting president has the power to undo previous national monument designations, raising legal questions about the potential consequences of the review. Interior Department staff members have been given 15 days to submit a plan for increasing mining on federal lands.
