Former North Dakota lawmaker ordered to report to jail by judge

Former North Dakota State Senator, Ray Holmberg, convicted of a child sex crime, was ordered to report to jail for violating the terms of his temporary release. Despite his age and medical problems, Holmberg was allowed to stay at home under certain conditions, including no drugs or alcohol and no internet use. However, reports from the U.S. Probation Office claimed that he violated these terms multiple times. Prosecutors requested a review of his release, arguing that his medical issues had cleared up. Holmberg’s attorney disputed the allegations, stating that he still suffers from medical problems.

U.S. District Judge Daniel Hovland ordered Holmberg to surrender to jail, noting that his age and medical ailments were not sufficient reasons to remain out of custody. Holmberg faces a maximum sentence of 30 years in prison and a $250,000 fine, with prosecutors seeking a sentence on the lower end of federal guidelines. His sentencing date has not been set.

Holmberg resigned from the North Dakota Senate in 2022 after a federal investigation. The Department of Justice and law enforcement agencies are concerned about the spread of child sexual abuse images created through artificial intelligence. Holmberg’s lawyer declined to comment on the recent developments.

The case has sparked a debate about whether age and medical problems should be factors in determining whether convicted individuals should remain out of custody before sentencing. It also highlights the ongoing issue of child sexual abuse and the use of technology in such crimes.
