After Supreme Court immunity ruling, Trump requests delay in documents case


Attorneys for Donald Trump have asked a federal judge to pause proceedings in his classified documents case to consider the impact of the Supreme Court’s ruling on presidential immunity. Trump’s lawyers argue that the charges against him stem from his official acts as President and should be dismissed. The Supreme Court decision stated that presidents have immunity for official actions while in office, and Trump’s team is seeking to use this ruling to have the case dismissed. Trump has pleaded not guilty to the 40 charges against him.

The court filing also referenced a statement by Justice Clarence Thomas, which argued that special counsel Jack Smith was not properly appointed. Smith’s office has called Trump’s immunity motion “frivolous” and argued that the charges against Trump are based on actions he took after leaving office. The Justice Department has not yet responded to Friday’s filing by Trump’s attorneys.

In a separate case, Trump’s lawyers have successfully used the Supreme Court ruling to delay his sentencing on 34 felony counts in New York. The sentencing has been postponed until September to allow the judge to consider Trump’s arguments. Trump’s defense team is using the Supreme Court ruling on presidential immunity to challenge the charges against him in both cases.
